1. Who We Are

Godberry Studios is a sole proprietorship operated from the Republic of Lithuania. These Terms of Service (“Terms”) govern your use of godberrystudios.com (the “Site”) and any content or tools we link to from the Site.

2. Acceptance

By accessing or using the Site you confirm that you are at least 16 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

3. What the Site Provides

The Site is an informational blog about web scraping, data extraction, and content automation. We publish tutorials, guides, and links to paid tools we operate on the Apify platform.

The Site itself does not process payments or host paid software. All paid tools run on Apify under Apify’s own Terms of Service and are billed by Apify directly. Your relationship with Apify is separate from these Terms.

4. Acceptable Use

When using the Site you agree not to:

  • violate any applicable law or regulation;
  • attempt to gain unauthorised access to any part of the Site or its underlying infrastructure;
  • scrape, crawl, or mirror the Site in a way that degrades service for other readers;
  • upload malicious code or attempt to probe for vulnerabilities;
  • misrepresent your identity or affiliation;
  • use tutorials or code examples published here to engage in activity that is unlawful in your jurisdiction or the jurisdiction of the target website.

Our tutorials teach web scraping techniques for legitimate research, market analysis, and automation. You are solely responsible for ensuring that your use of any technique complies with the target website’s terms of service, robots.txt, applicable data protection law (including GDPR), and anti-circumvention statutes in your jurisdiction.

5. Intellectual Property

All original articles, code samples, images, and other content published on the Site are © Godberry Studios unless stated otherwise. You may:

  • read, share, and link to our articles;
  • reproduce short quotations with attribution and a link back to the original article;
  • use code samples under the MIT License unless a different licence is stated on the article.

You may not republish full articles on other websites without our written permission.

6. No Warranty

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Articles are written for educational purposes; we do not guarantee that any technique, code example, or third-party service described will continue to work, remain legal, or be free of defects.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Godberry Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site.

Our total aggregate liability for any direct damages arising from your use of the Site is limited to one hundred euros (€100).

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence, or the statutory rights of consumers under Lithuanian and EU law.

8. Indemnification

You agree to indemnify and hold harmless Godberry Studios from any claim, damage, or expense (including reasonable legal fees) arising from (a) your breach of these Terms or (b) your use of any technique or information published on the Site in a manner that violates the rights of a third party or applicable law.

9. Third-Party Services

The Site links to third-party services including Apify, Cloudflare, and various websites referenced in tutorials. We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of a third-party service is governed by that service’s own terms.

10. Termination

We may suspend or terminate your access to the Site at any time, without notice, if you breach these Terms or engage in conduct that harms the Site or other readers. Sections that by their nature should survive termination (Intellectual Property, No Warranty, Limitation of Liability, Indemnification, Governing Law) will remain in effect.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lithuania, subject to any mandatory consumer protection laws of your country of residence that grant you additional rights.

12. Changes

We may update these Terms from time to time. Material changes will be announced on this page with a new effective date. Continued use of the Site after a change means you accept the updated Terms.
